知的財産はどこまで守られるべきか

知的財産は法律で守るのは当然なことです。しかしどこまで守るべきかについては議論の余地があるのではないかと思います。 つまらない「出羽守」投稿だと思われても仕方ありませんが、ネットの１ユーザーとして少しだけ愚痴らせてもらうと、日本の著作権法律を少し窮屈に感じることがあります。 以前から気になったことです。具体的にどのような法律の違いがあるか分かりませんが、日本が欧米と比べて著作権侵害を厳しく取り締まっていることは明らかだと思います。 例えばアメリカでは、著作物は批評、風刺、教育などの様々な目的で使用が許容されています。そのおかげで、テレビや映画、ニュースなどを題材にされた多くのコンテンツが生まれ、ネットでの言論の活性化につながりました。これはネタ動画だけではなく、教育価値の高いコンテンツも含むのです。 しかし日本では画像、映像を始めとする著作物の使用はかなり限られているのではないかと思います。しかし法律の知識がないためどこまで、どのように限られているかは詳しく言えません。一つ言えるのは上で説明したような著作物を使ったコンテンツはおそらく日本では作れない、あるいはもし作られたとしてもその多くは削除される可能性が高いということです。 日本のウィキペディアでさえ、画像に対する著作権の法律があまりに厳しいせいか、多くの著名人の記事に写真が付いていません。 しかしまあ、著作権は文字通り、「権利」なのでそれを守るということは悪いとは言えません。一方、「守りすぎる」と言論が萎縮してしまうこともあります。 だから画像、映像をあまり自由に使えない日本のネット空間が窮屈というか、ちょっと寂しいと思うことがあるのです。 ただ私の認識が間違っていればぜひ教えていただきたいですし、私が知らないだけで、著作権侵害への厳しい取り締まりに何かの利点もあるでしょう。 「知らないくせに、よく書けるなこいつ」（自分の投稿につっこんでみました。笑） いつもお読みいただき、ありがとうございます。 添削のほど、よろしくお願いします。

Even Wikipedia in Japan does not have photos of many notable figures in its articles, perhaps because the copyright laws for images are so strict. Well, copyright is literally a "right," so protecting it is not a bad thing. On the other hand, "too much protection" may cause speech to atrophy. That is why I thought that the Japanese Internet space, where images and video cannot be used so freely, is stifled or a bit lonely.
